The Conference will mark the conclusion of a three-year’s joint project of the Bonn and Tel Aviv Universities. During the past three years, Professor Leora Bilsky, Tel Aviv University, and Professor Weller invited Israeli and German students to come together weekly on screen in the Winter Semesters from 2021 to 2023 to receive lectures on the restitution of Nazi-looted art in comparative perspectives, presented by the Professors and a large number of international guest speakers from diverse backgrounds. This input included interdisciplinary perspectives from both provenance research and law as well as legal comparative perspectives, mainly from jurisdictions that implemented Washington Principles Numbers 10 and 11 (Germany, Austria, Netherlands, France, UK) and from jurisdictions that are currently in the process of implementing these Principles (Israel, Switzerland).

The project thus anticipated a demand formulated at the Terezin Declaration Conference 2022 in Prague, namely to develop and intensify formats for teaching on the restitution of property looted in the Holocaust, in particular Nazi-looted art. Over the last three years, the project has generated valuable experiences in teaching this challenging subject and significant insights on the subject matter.

It is the objective of this Conference to reflect and discuss the fruits of the project and to provide for an outlook on the next 25 years of the Washington Principles, after their 25th anniversary on 3 December 2023.

Im 25. Jahr der Washingtoner Prinzipien ist vieles erreicht worden, zugleich stellen sich nach einem Vierteljahrhundert der Umsetzung und Praxis alte und neue Fragen, und zwar sowohl auf der Ebene der Provenienzforschung als auch auf Ebene der darauf basierenden Konfiguration gerechter und fairer Lösungen:

Die Provenienzforschung hat sich durch Standards in der Methodik und Dokumentation etabliert, professionalisiert und in die Wissenschaftsgeschichte eingeschrieben. Ursprünglich im Rahmen der Washingtoner Prinzipien politisch motiviert, zeichnet sich die genuin interdisziplinäre Forschung seitdem durch ein wechselseitiges Verhältnis zu Politik und Rechtswissenschaft aus. Vor dem Hintergrund der damit verbundenen Ansprüche, Erwartungen und Herausforderungen wird der erste Vortrag den Stand der Provenienzforschung aus wissenschaftlicher Sicht reflektieren und Aspekte zur Transparenz als leitendes Prinzip bündeln.

Auf Ebene der Konfiguration gerechter und fairer Lösungen haben sich teilweise prozedurale und materielle Standards etabliert, teilweise prallen unterschiedliche Positionen unvermittelt aufeinander. Soweit Konsensbereiche nach 25 Jahren Praxis entstanden sind, sollten diese festgehalten und sichtbar gemacht werden, einerseits um unproduktive Wiederholungen längst geklärter Kontroversen zu vermeiden, andererseits um Qualität, Professionalität und Geschwindigkeit der Fallbearbeitung zu steigern. Konfliktpunkte sollten hingegen in präziser Kenntnis der tatsächlichen Ansätze in der Praxis möglichst rational und methodisch fundiert Lösungsvorschlägen zugeführt werden, die dann in einem informierten Diskurs sinnvoll verhandelt werden können. Hierzu wird der zweite Vortrag Angebote machen, dies in Rückbindung an Kernpunkte der Washingtoner Prinzipien.

Im Anschluss an beide Vorträge laden wir das Auditorium zur Diskussion ein. Nach Abschluss der Veranstaltung soll ein kleiner Umtrunk den informellen Austausch ermöglichen und den Abend ausklingen lassen.

The Restitution Dialogues:

Exploring the Vatican Archives

The Vatican Archives in Rome house tens of thousands of Indigenous items, many from Canada.  In light of the Church’s role in Canada’s residential schools and the larger global conversation about cultural loss and the return of colonial-era cultural property, pointed questions are being asked about the return of Indigenous cultural items to their communities.  In this instalment of the Restitution Dialogues, we seek to further the discussion of these important questions by exploring the history of the Vatican collection and locating that history in the larger context of debates and practices concerning cultural loss, transfer, and return.  The panel will discuss items such as the broader impact of the contemporary ‘restitution revolution’, the nature and provenance of Indigenous material in the Vatican collection, institutional best practices in restitution and repatriation, and the cultural impact of return and renewal. 

This conference is part of the ongoing “Restitution Dialogues” conference series and also serves as the closing session of the joint class of the Universities of Tel Aviv and Bonn entitled “Restitution of Nazi-Looted Art in Comparative Perspectives” (part of the winter semester).

This conference is the culmination of a semester-long, unique course titled ‘Nazi-Looted Art: Law and Provenance Research’, a special collaboration between the Rheinische Friedrich-Wilhelms-Universität Bonn, funded by its programme of excellency (Transdisciplinary Research Area [“TRA”] 4), and Tel-Aviv University.

Over 75 years have passed since the end of WWII and the issue of Nazi-looted art is still very much present and even growing. Museums and private owners worldwide and in Israel still hold artworks looted from Jews during the Holocaust which have not yet been restituted. In 1998 the Washington Conference set up principles for the restitution of artworks confiscated during the years 1933-1945. The course was the first comprehensive attempt to bring together law and art-history students, from Israel and Germany, and academically teach them two primary disciplines: the legal framework for restitution; and provenance research. The course aimed at providing historical context and research methods, and discussing their interaction with the legal issues raised, such as what can be considered a ‘just and fair solution’ as stipulated in the Washington Principles.

This conference is an opportunity to widen the scope of looted art and go beyond questions of law into politics (Gaudenzi) and philosophy (Kenaan) of restitution as well as beyond the Nazi era into questions arising out of colonial-era looted art and artefacts (Herman). It is also an opportunity to invite the wider public to get acquainted with the subject of looted art and the unique experiences that this course summoned.

Die Frage, ob privatrechtlich organisierte Einrichtungen an einer freiwilligen Rückgabe von NS-verfolgungsbedingt entzogenem Kulturgut gehindert sind, stellt sich besonders für Stiftungen. In der Vergangenheit haben sich einzelne Stiftungsvorstände Restitutionsverlangen mit dem Argument widersetzt, Stiftungen dürften wegen des stiftungsrechtlichen Vermögenserhaltungsgebots keine solchen freiwilligen Leistungen erbringen. Demgegenüber heißt es in der Begründung des derzeit im Bundestag beratenen Gesetzentwurfs zur Vereinheitlichung des Stiftungsrechts (BT-Drucks. 19/28173, S. 56), eine Rückgabe in Umsetzung der Washingtoner Prinzipien liege 'regelmäßig' im wohlverstandenen Interesse einer Stiftung. Der Vortrag ordnet diese Aussage vor dem Hintergrund des geltenden und künftigen zivilen Stiftungs- und steuerlichen Gemeinnützigkeitsrechts näher ein und plädiert für eine differenzierte Lösung.

Bewertungsfragen stellen sich an vielen Stellen unserer Rechtsordnung – im Steuerrecht und Zivilrecht regelmäßig dann, wenn die Höhe eines Geldanspruchs vom Wert eines oder mehrerer Wirtschaftsgüter abhängt. Rechtlicher Vorgaben für die Bewertung bedarf es dann, wenn die Rechtsordnung aus Gerechtigkeitserwägungen einen Bewertungsmaßstab vorgibt, um eine willkürliche Zuordnung von Geldwerten zu verhindern. So kann beispielsweise der Erbe einer Kunstsammlung die einzelnen Werke zu einem beliebigen Preis verkaufen. Geht es aber um die Höhe der hierauf anfallenden Erbschaftsteuer oder um die Höhe des Pflichtteilsanspruchs eines übergangenen Erben, muss der Wert der Kunstgegenstände nach rechtlichen Vorgaben ermittelt werden. Der Vortrag skizziert, wie rechtliche Standards für die anlassgerechte Bewertung von Kunstgegenständen entwickelt werden können.

Im Anschluss an die Vorträge ist eine Diskussion vorgesehen.

The conference series “Bonn Talks on Art and Cultural Property Law” was set up by the Chair for Art and Cultural Property Law, established at the University of Bonn in 2018. Its first event was a presentation by the Chair of the German Advisory Commission on the return of cultural property seized as a result of Nazi persecution („Beratende Kommission“), former President of the German Federal Constitutional Court Prof Dr Hans-Jürgen Papier. The series has since addressed a number of issues related to the restitution of Nazi-looted art. In the forthcoming event, recent developments in the Netherlands will be the topic, and the Chair is cooperating with the Center for Research on Dutch Jewry at the Hebrew University of Jerusalem.

The Dutch Restitution Commission’s policy on restitution of cultural objects lost during the Second World War was evaluated in December 2020 by the “Kohnstamm Committee”. This body was established by the Council for Culture (“Raad voor Cultuur”) in the Netherlands and is named after its chairman Jacob Kohnstamm who is giving us the honour of the keynote address for our event.

In order to evaluate the practice of the Dutch Restitution Commission and to issue recommendations for the improvement of its work, the Kohnstamm Committee studied policy documents and examined publications, and also asked stakeholders and academics for their opinions and suggestions. The Report of the Committee addresses issues such as provenance research, the procedural rules and the substantive criteria for evaluating the moral strength of a claim for restitution.

As an introduction, Matthias Weller and Tessa Scheller will briefly summarize the main conclusions of the Report. In his keynote address, Jacob Kohnstamm will address central issues. Gert-Jan van den Bergh and André Boers will respond and provide comments on selected aspects. Speakers and interventions in the following discussion with the audience via the chat function are encouraged to put the findings of the Dutch efforts for reform into an international context, in particular with regard to four other Restitution Commissions in Germany, Austria, France and the United Kingdom, but also beyond these countries in Europe and elsewhere.

Einladung zum Bonner Gesprächskreis Kunst- und Kulturgutschutzrecht

Liebe Kolleginnen und Kollegen, sehr geehrte Damen und Herren, es freut uns sehr, dass wir unseren Bonner Gesprächskreis zum Kunst- und Kulturgutschutzrecht mit folgender Veranstaltung fortsetzen können:

 

Das Kunstmuseum Basel hatte im Mai 1933 an einer Auktion in Berlin rund 200 Zeichnungen und druckgrafische Werke aus der Sammlung Dr. Curt Glaser erstanden. 2004 ersuchte ein amerikanisches Anwaltsbüro im Namen der Erbengemeinschaft Curt Glaser das Kunstmuseum Basel um Auskunft über zwei Lithografien von Edvard Munch. Drei Jahre später erhoben die Erben Anspruch auf alle an der Auktion erworbenen Kunstwerke, allenfalls gegen Entschädigung des damals gezahlten Kaufpreises. Der Regierungsrat des Kantons Basel-Stadt entschied sich 2008 gegen die Rückgabe der Werke.

Ende 2017 trat die Erbengemeinschaft erneut mit dem Präsidialdepartement in Kontakt. Das Kunstmuseum Basel sowie die Kunstkommission nahmen diese Kontaktaufnahme zum Anlass, gemeinsam den Fall Curt Glaser neu zu prüfen. Zu diesem Zweck wurde im Kunstmuseum Basel eine Arbeitsgruppe gegründet, die sich vertieft mit dem Fall auseinandersetzte und schließlich eine gerechte und faire Lösung vorlegte.

Unsere Referenten, Frau Dr. Anita Haldemann und Herr Prof. Dr. Felix Uhlmann, waren an dieser Arbeit maßgeblich beteiligt und tragen zu den historischen und rechtlichen Herausforderungen bei der Erarbeitung der gefundenen Lösung vor. Im Anschluss besteht Gelegenheit zur Diskussion. Hierzu laden wir Sie herzlich ein.

Der Vortrag widmet sich vor diesem Hintergrund der Frage, was bei einer Restitution nationalsozialistischer Raubkunst aus privater Hand gerecht und fair ist. Kann sie nach den gleichen Grundsätzen beurteilt werden wie eine Restitution aus staatlichen Museen? Im Anschluss an den Vortrag ist eine Diskussion mit dem Auditorium vorgesehen.
